Christian Mayor Addresses Pennsylvania Atheist Conference

I still can?t believe Harrisburg Mayor Linda Thompson gave the opening remarks at the Pennsylvania State Atheist/Humanist Conference this weekend, but she made her way into the lions? den and spoke to the crowd:

Thompson said she was there acting as an ambassador to the city, encouraging the crowd to get out to see the city sights and spend money in Harrisburg.

Even though she is a devout Christian who has been criticized by former employees and the public for blurring religion with state and criticizing another city official for his sexual orientation, Thompson told the group she respected its right to gather in the city despite their differences.

?I believe in prayer. I pray all the time. For me, in my personal life, I believe. But as the mayor, I have to be fair to everyone, and I do,? Thompson said during her speech.

?I believe that individually, no matter what we believe in, we should treat each other as human beings and be fair to one another and not demonize each other,? she continued.

?Not demonize each other?? I?d take her more seriously if she didn?t allegedly call one of her political rivals ?that homosexual, evil little man.?

Still, for the most part, the atheists in the crowd seemed to appreciate her message yesterday:

?At an atheists convention any mention of God probably seems too religious to the atheists, but I think she represented fairly the position the mayor should have, which is that of neutrality when it comes to religion,? said Scott Rhoades, founder of the Free Thought Society.

?I respect the part (of the mayor?s speech) about respect. I respect the part about loving each other. I respect the part about getting along,? Rhoades added. ?But I was a little dismayed about the number of times God came up. But she is a minister, it?s expected I guess for her to squeeze God in as much as she can.?

?

?I appreciate her visit,? [Claire Larson, secretary for the Free Thought Society] said. ?I?m not offended by difference of opinion. We certainly know not everyone sees things the way we do as atheists. (Thompson) was simply stating her perspective as she sees it and she was using her background to explain her reasoning for wishing to be present to welcome our group to Harrisburg.?

A few atheists were upset at the number of times Thompson referred to God and prayer in her speech? but what else were you really expecting. She?s a Christian, even if she?s a mayor. You just have to let some shit slide. I wouldn?t care about her personal beliefs so much if they didn?t affect her public positions; unfortunately, Thompson has blurred those lines before. As far as I can tell, Thompson didn?t refer to any of her past instances of combining church and state in her speech.

That said, I think she did the right thing by accepting the atheists? invitation. Let?s hope some reason rubbed off on her while she was there.

Gettysburg College receives $600,000 Mellon grant

The Andrew W. Mellon Foundation has awarded Gettysburg College a $600,000 grant that will allow more students, especially first-years and sophomores, to undertake faculty-mentored research or creative work. The four-year grant also provides funding for course development, on-campus workshops for faculty, and integration of digital technologies into coursework and scholarship.

?The grant builds on two previous Mellon grants. In 2006 the Foundation awarded the College seed money for a pilot summer faculty-mentored research program. An additional $500,000 grant over five years expanded the successful program from 2008-2012 and supported faculty in mentoring course development. Ten Gettysburg students conducted summer research projects with Mellon support this past summer.

?Once again, The Andrew W. Mellon Foundation has made an extraordinary investment in a Gettysburg College education,? said College President Janet Morgan Riggs ?77. ?This grant supports our goal to deepen the intellectual engagement of our students and to provide a rich and active learning experience that will prepare our students well for their lives beyond Gettysburg.?

The impact of the past support is plainly evident each spring, when hundreds of students, many of whom received Mellon funds for their projects, share their work with the campus community at a full-day colloquium, comprising poster sessions, academic talks, and creative performances. Students also attend or present at domestic or international conferences in their fields throughout the year.

?With support from The Mellon Foundation, the College has made great strides in expanding undergraduate research and creative work from the province of the natural sciences to the arts, humanities, and social sciences,? Gettysburg College Provost Christopher Zappe said. ?Not only are more students submitting proposals for research or creative work, but more faculty are eager to mentor them through their projects,? Zappe said. ?There is more activity and it is more inclusive.?

The Mellon grant will also help faculty create or redesign courses to be more discovery-based and to engender student interest in projects earlier in their academic careers. An International Bridge Course will be developed to help integrate study abroad more seamlessly into students? academic programs. Gettysburg?s Instructional Technology staff will design workshops on developing digital projects for use in classes or student-faculty collaborative research.

Much of the funding is dedicated to providing opportunities for active learning, one?of five goals of Gettysburg Great, The Campaign for Our College. The comprehensive fundraising campaign will increase support for student scholarships, active learning opportunities like research and internships, faculty and teaching, a renovation of Plank Gymnasium, and the Gettysburg Fund.

Founded in 1832, Gettysburg College is a highly selective four-year residential college of liberal arts and sciences with a strong academic tradition. Alumni include Rhodes Scholars, a Nobel laureate, and other distinguished scholars. The college enrolls 2,600 undergraduate students and is located on a 200-acre campus adjacent to the Gettysburg National Military Park in Pennsylvania.

Knock, knock: CMS leaders look for dropouts | CharlotteObserver.com

Superintendent Heath Morrison probably doesn?t get stood up much. But when he and Charlotte-Mecklenburg Schools social worker Heidi Berger arrived for a home visit with a dropout Friday morning, they found no one home.

That was no surprise to Berger, who has done hundreds of home visits. Even after you make an appointment, she said, families often decide they don?t want to deal with social workers or confront their children?s problems.

Nor was Morrison shocked. He launched a ?door to door for student success? campaign this week to get teens back in school, but also to give top administrators and elected officials a close-up look at the reality behind dropout statistics.

?It?s not easy,? Morrison said. ?Yesterday was awesome. Today?s frustrating.?

?Yesterday? was the first of two home visits Morrison opened to the media, with the understanding that students and families wouldn?t be exposed to coverage unless they agreed. The district has identified students who were enrolled last year and haven?t showed up this year. School social workers, accompanied by top administrators, school board members and mayors, are making appointments to talk to those students and their families about options for getting back on the diploma track. They contacted about 100 students in the first two days.

Thursday, Morrison and counselor Melanie Williams visited Karen Gonzales, who left Garinger High to work full time at McDonald?s when her mother fell ill. Two older sisters also had dropped out of high school. The mother was doing better, and Gonzales, who has almost enough credits to graduate, was already thinking about how to get back in school. She eagerly agreed to return, riding back to Garinger with the social worker.

Friday morning, at a middle-class subdivision in northeast Charlotte, the superintendent and the social worker knocked to no avail, even though the student was supposed to be home and the mother was supposed to meet them there.

Standing outside, Morrison and Berger talked about the challenges of getting teens back on track.

On Thursday, Berger had met with a 19-year-old whose mother described him as ?a slow learner,? but who had never qualified for special education services. He?s looking for work, but finding a job without a diploma is difficult.

That student has only half the credits needed to graduate, so returning to a regular high school isn?t practical. Berger outlined several options, including alternative schools in CMS, a charter school, Job Corps and the GED program at Central Piedmont Community College.

Morrison noted that tracking down dropouts and making home visits is nothing new: ?CMS does have social workers that have been doing this for a long time, and doing a great job.? Adding the high-level visitors is designed to boost the public profile and provide policymakers with a deeper understanding of the issues.

Morrison is likely to include new options for struggling students as part of the plan he?ll unveil after 100 days on the job. When he was superintendent in Reno, Nev., he created ?reclamation centers? located in areas with lots of at-risk students. Not only can potential dropouts earn credits online, with assistance designed to get them back into regular schools, but groups providing social services work to support the entire family.

Morrison wouldn?t say whether he wants to launch a similar program in Charlotte, but he said CMS needs more options. And the community has a strong base of partners eager to help, he said.

Morrison said he?d also like to replicate the CMS Performance Learning Center in more locations around Mecklenburg County. The center, created in partnership with Communities in Schools, offers online classes with teacher support for students who haven?t done well in traditional high schools.

Forty-five minutes after Friday?s scheduled appointment, the student and her mother pulled up. Morrison and Berger went in to talk with them. They didn?t want to talk to reporters, and Morrison wouldn?t give personal details. But he said the student is interested in graduating from CMS and will have a follow-up appointment with Berger. Morrison said he told the girl he wants to hand her a diploma.

Mother and daughter pulled out, but a couple of minutes later, their SUV looped back. The student wanted her picture taken with Morrison and Berger.

They looped their arms around her while a CMS staffer took a photo. She and her mother drove away again ? with proof that someone at the top cares about her future.

Ryan Sasson, Legal Helpers Debt Resolution and Others Sued by ...

On September 11, 2012 a suit was filed in New York by employees against LHDR Help, Legal Helpers Debt Resolution, Macey Aleman Hyslip & Searns, Thomas Macey, Jeffrey Aleman, Jeffrey Hyslip, Jason Searns, Credit Advocates Law Firm, and Ryan Sasson.

The suit was filed by Benjamin Xue, Esq. & Brian Shenker, Esq, 401 North Broadway, Suite 1009, New York, New York, 212-219-2275.

The most startling allegation made in the complaint, for me, was ?Plaintiffs were also forced to endure an unprofessional and discriminatory work environment. Drug use, including marijuana and cocaine, ran rampant in the company. In fact, managers and supervisors were aware that drugs were stored at the business location and employees and supervisors used drugs or had knowledge of drug use at the business location.?

This is an interesting suit since not long ago Ryan Sasson was brought onboard at LHDR to clean things up. ? Source

The Suit

This lawsuit seeks to recover unpaid minimum wage and overtime compensation for Plaintiffs and their similarly situated co-workers who have been employed by LHDR HELP, LLC, LEGAL HELPERS DEBT RESOLUTION, LLC, MACEY, ALEMAN, HYSLIP & SEARNS, THOMAS G. MACEY, JEFFREY J. ALEMAN, JEFFREY HYSLIP, JASON E. SEARNS, CREDIT ADVOCATES LAW FIRM, LLC, and RYAN SASSON (collectively ?LHDR? or ?Defendants?) in New York State.

2. LHDR Help, LLC is a Delaware based debt~resolution company operating in New York and other states throughout the country. Legal Helpers Debt Resolution, LLC is a Nevada based debt-resolution company which does business in New York through the law firm partnership of Macey, Aleman, Hyslip & Searns, which claims to be the nation?s largest debt resolution law firm.

Notably, Legal Helpers Debt Resolution, LLC a/k/a Law Offices of Macey, Aleman, Hyslip & Seams were recently sued by the Illinois Attomey General for consumer fraud. A settlement was reached whereby Defendants can no longer offer debt settlement in Illinois.

Upon information and belief; lawsuits have also been filed against Defendants for similar reasons in Califomia and New Jersey.

Plaintiffs worked for LHDR as ?debt consultants? in Defendants? Manhattan office. ?Debt consultants? duties are to call individuals, identified by Defendants, and attempt to sign people up for debt settlement programs, and to answer phone calls. Plaintiffs are provided a script and their sole duty is to make phone calls to individuals, also known as ?leads.? ?Debt consultants? must receive approval from Defendants prior to making any debt resolution offer to a client.

?Debt consultants? are compensated by Defendants entirely through commissions. Commission is not guaranteed. In order to receive commission, ?consultants? must sign up a client for debt settlement enrollment program with Defendants and said client must begin making debt settlement payments to Defendants for Plaintiffs to receive their commission. Plaintiffs? receipt of commissions is conditioned upon the completion of transactions by other LHDR employees.

Defendants gave ?debt consultants? productivity goals on daily, weekly, and monthly basis. In order to meet the productivity goals, ?debt consultants? are often required to work in excess of 40 hours per week. Sometimes ?debt consultants? were required to come to work on Saturdays. Debt consultants often worked over 12 hours per day in order to meet their productivity goals.

Defendants would discipline or penalize ?debt consultants? who did not arrive at work at the hours specified by Defendants.

Plaintiffs bring this action on behalf of themselves and similarly situated current and former employees of Defendants who elect to opt-in to this action pursuant to the FLSA, 29 U.S.C. ?? 201 et seq., and specifically, the collective action provision of 29 U.S.C. ? 216(b), to remedy violations of the wage-and-hour provisions of the FLSA by Defendants that have deprived Plaintiffs and others similarly situated of their lawfully earned wages.

Plaintiffs also bring this action on behalf of themselves and all similarly situated current and former employees of Defendants who worked in New York pursuant to Federal Rule of Civil Procedure 23 to remedy violations of the NYLL, Article 19, ?? 650 et seq., and the supporting New York State Department of Labor Regulations.

Plaintiff David Song was employed by Defendants as a ?debt consultant? in their Manhattan office from approximately December 2011 until approximately August 2012.

Plaintiff Edwin Mosquera was employed by Defendants as a ?debt consultant? in their Manhattan office from approximately December 201 1 until approximately June 2012.

Plaintiff Gerald Roger has been employed by Defendants as a ?debt consultant? in their Manhattan office from approximately July 2011 to the present.

Each Defendant has had substantial control over Plaintiffs? working conditions, and over the unlawful policies.

LHDR Help, LLC

LHDR Help, LLC is a foreign business corporation, organized and existing under the laws of Delaware.

LHDR Help, LLC has a place of business in New York located at 1400 Broadway, New York, NY 10018.

Upon information and belief; LHDR Help, LLC is a subsidiary of and/or is controlled by Legal Helpers Debt Resolution, LLC, Macey Aleman, Hyslip & Seams, and Credit Advocates Law Firm, LLC.

Throughout the relevant period, LHDR Help, LLC employed Plaintiffs and similarly situated employees within the meaning of the FLSA and NYLL.

LHDR Help, LLC is a covered employer within the meaning of the FLSA and NYLL and, at all times relevant, employed and/or jointly employed Plaintiffs and similarly situated employees.

At all times relevant, LHDR Help, LLC maintained control, oversight and direction over Plaintiffs and similarly situated employees, including timekeeping, payroll, and other employment practices that applied to them.

LHDR Help, LLC applies the same employment policies, practices, and procedures to all ?debt consultants? and employees similarly situated to Plaintiffs.

Legal Helpers Debt Resolution, LLC is a foreign business corporation, organized and existing under the laws of Nevada.

Legal Helpers Debt Resolution, LLC has a place of business in New York located at 1400 Broadway, New York, NY 10018.

Upon information and belief, Legal Helpers Debt Resolution, LLC is owned, controlled, and/or a subsidiary of Macey, Aleman, Hyslip & Seams, LHDR Help, LLC, and Credit Advocates Law Firm, LLC.

Throughout the relevant period, Legal Helpers Debt Resolution, LLC employed Plaintiffs and similarly situated employees within the meaning of the FLSA and NYLL.

Legal Helpers Debt Resolution, LLC is a covered employer within the meaning of the FSLA and NYLL and, at all times relevant, employed and/or jointly employed Plaintiffs and similarly situated employees.

Throughout the relevant period, Macey, Aleman, Hyslip & Seams employed Plaintiffs and similarly situated employees within the meaning of the FLSA and NYLL.

Upon information and belief, JeHrey J. Aleman has had the power over personnel decisions at LHDR Help, LLC, Legal Helpers Debt Resolution, LLC, and Macey, Aleman, Hyslip & Seams.

Upon information and belief at all times relevant, Jeffrey J. Aleman has also had the power to stop any illegal pay practices that harmed Plaintiffs and similarly situated employees.

Upon information and belief Jeffrey J. Aleman has had the power to enter into contracts on behalf of LHDR Help, LLC, Legal Helpers Debt Resolution, LLC, and Macey, Aleman, Hyslip & Searns.

Facts

Plaintiffs bring the First and Third Causes of Action, pursuant to FLSA, 29 U.S.C. ? 2l6(b), on behalf of themselves and all similarly situated persons who work or have worked for Defendants as ?debt consultants? in New York State, on or after the date that is three years before the filing of the Complaint in this case, who elect to opt-in to this action (the ?FLSA Collective?).

All of the work that Plaintiffs and the FLSA Collective have performed has been assigned by Defendants, and/or Defendants have been aware of all the work that Plaintiffs and the FLSA Collective have performed.

As part of its regular business practice, Defendants have intentionally, willfully, and repeatedly engaged in a pattern, practice, and/or policy of violating the FLSA with respect to Plaintiffs and the FLSA Collective. This policy and pattern or practice includes, but is not limited to:

Willfully failing to pay its employees, including Plaintiffs and the FLSA Collective, overtime wages for hours that they worked in excess of 40 hours per workweek; and b. Willfully failing to record all of the time that its employees, including Plaintiffs and the FLSA Collective, have worked for the benefit of Defendants.

Defendants are aware or should have been aware that federal law required them to pay employees performing non-exempt duties an overtime premium for hours worked in excess of 40 per workweek.

Plaintiffs and the FLSA Collective perform or performed the same primary duties.

Defendants? unlawful conduct has been widespread, repeated, and consistent.

The members of the Rule 23 Class are so numerous that joinder of all members is impracticable.

Upon information and belief, the size of the Rule 23 Class is at least 50 individuals.

Although the precise number of such employees in unknown, the facts on which the calculation of that number depends are presently within the sole control of Defendants.

Defendants have acted or have refused to act on grounds generally applicable to the Rule 23 Class, thereby making appropriate final injunctive relief or corresponding declaratory relief with respect to the Rule 23 Class as a whole.

Throughout the duration of their employment with Defendants, Plaintiff consistently worked more than 40 hours per week, and oftentimes worked more than 60 hours per week.

Plaintiffs? work projects were delegated to them by their supervisors. Plaintiffs?
hours were also dictated by their supervisors.

Defendants were aware that Plaintiffs were working well over 40 hours per workweek, but Defendants failed to pay any overtime compensation for any of the hours they worked over 40 in a workweek.

Plaintiffs were compensated solely by commissions earned and received no hourly pay or salary.

Defendants did not keep accurate records of hours worked by Plaintiffs. Plaintiffs were not required to clock in or out or otherwise record their time and their hours are not reflected on their paystubs.

Plaintiffs? primary duties were routine tasks, including, but not limited to:

  • Calling potential clients to get them to sign up for debt reduction programs; and
  • Soliciting new clients.

Plaintiffs? primary duty was not directly related to Defendants? management or general business operations.

Plaintiffs? primary duty did not include the exercise of discretion and independent judgment regarding matters of significance.

Plaintiffs were also forced to endure an unprofessional and discriminatory work environment. Drug use, including marijuana and cocaine, ran rampant in the company. In fact, managers and supervisors were aware that drugs were stored at the business location and employees and supervisors used drugs or had knowledge of drug use at the business location.

Plaintiffs, including David Song and Edwin Mosquera, were subject to a hostile work enviromnent and race discrimination. Plaintiffs? supervisors continually and against Plaintiffs? protests made derogatory comments to Song and Mosquera regarding their race. Such conduct included but is not limited to inappropriate emails, inappropriate comments, and gestures.

During approximately the first two months of Plaintiffs? employment by Defendants, Plaintiffs were paid only a draw, without earning any commissions. Plaintiffs were required to repay the draw to Defendants once they began eaming commissions. Plaintiffs? rate of pay during such periods fell below the required minimum wage.
124. Defendants willfully failed to compensate Plaintiffs the applicable minimum hourly wage, in violation of 29 U.S.C. 206(a).

Defendants? violation of the FLSA, as described in this Complaint, has been willliil and intentional.

Due to Defendants? FLSA violations, Plaintiffs and other similarly situated employees are entitled to recover from Defendants, jointly and severally, their unpaid minimum wages and an equal amount in the form of liquidated damages, as well as reasonable attomeys? fees and costs ofthe action, pursuant to the FLSA, specifically 29 U.S.C. 216(b), all in an amount to be determined at trial. ? According to WFAA, Lewis cannot use cellphones, televisions, computers or cars; she avoids plastic, covers part of her living room wall "with aluminum foil to block a cable box inside" and wears a gas mask when she goes outside.

?It?s a hard life,? she told the station. ?It?s challenging.?

The staggering limitations of Lewis' life boggle the mind. But incredibly, the 53-year-old woman is not alone in her plight.

In 2006, the BBC reported that a woman named Louise Solomons suffers from a similar disorder called multiple chemical sensitivity.

Diagnosed in 1988, Solomons is "allergic to the things that are part and parcel of the 21st Century," including many everyday chemical-based products such as perfume and furniture polish.

Solomons also told the BBC that she had started having reactions to electricity. Describing her life as "unbearably bleak," Solomons said that the stigma that surrounds the disorder makes coping with it even more challenging.

"People like me are treated like pariahs and acceptance of the condition comes hard," she said. "But do you think I would have given up a satisfying life to live in the middle of nowhere with ghastly symptoms if I had a choice?"

According to reports, some doctors and scientists are skeptical or dismissive of chemical and electrical sensitivities, with some saying that the condition may be psychosomatic.

"People who are intolerant of chemicals in everyday products or the environment often find their problems ignored or brushed aside by other people, even their doctors," wrote HuffPost blogger Leo Galland in a post about chemical sensitivities this August.

But, as WFAA notes, there are doctors who say that the conditions are very real and should be recognized as such.

"It?s a real phenomenon, and people are going to have to look into it more and more as time goes on,? said Dr. William Rea, who says he treats "hundreds of people for chemical and electrical sensitivity" at his clinic, the Environmental Health Center.

According to the BBC, Michael Clark, who in 2006 was the scientific spokesman for UK's Health Protection Agency, concurred.

"We don't contest that some people get some disabling symptoms which are very real," he said of electrical sensitivity, adding that there has been "evidence that some people are sensitive to some chemicals."
