Law protecting Afghan women has "long way to go": U.N. (Reuters)

KABUL (Reuters) ? Afghan authorities are failing to enforce the law to protect women from murder, beating, rape and other violence and being sold into marriage and prostitution, the United Nations said on Wednesday.

The U.N. Assistance Mission in Afghanistan (UNAMA) revealed in a report that only a small number of cases of violence against women have been prosecuted under the Elimination of Violence Against Women law, passed more than two years ago.

Prosecutors in Afghanistan filed indictments in 155 cases of 2,299 estimated incidents of violence against women, the U.N. mission said in the report.

Just 101 cases were brought to court for final judgments.

"There is still a long way to go to ensure that more cases of violence against women are prosecuted," UNAMA human rights director Georgette Gagnon told reporters.

She said cases that are prosecuted "sends a message that these are crimes and they need to be stopped and perpetrators . . . need to be punished."

Women had few rights under the harsh rule of the Taliban, who were ousted in 2001, and an improvement in the lot of women has been a top priority of Western backers of the government of President Hamid Karzai, who has ruled since then.

The law, passed in August 2009, supports equality for women, including criminalizing child and forced marriage, selling and buying women for marriage or for settling disputes, as well as forced self-immolation, among other acts.

But police, prosecutors, governors and other officials have only sporadically enforced the law, UNAMA said in the report.

Most cases were still unreported and some withdrawn. Some murder cases, for example, were instead prosecuted under sharia law, which sometimes resulted in acquittal of the perpetrators or lighter sentences.

In other cases, the female victims themselves were in turn accused of so-called moral crimes. Low numbers of female police, a lack of women's shelters and overuse of mediation in areas such as domestic violence also discouraged women from filing complaints.

"In some cases, authorities inappropriately pressured women to withdraw complaints and opt for mediation," said Gagnon.

The U.N. mission recommended raising awareness of the law among all levels of government and officials and to train prosecutors, police and judges better on how to apply the law.

In addition, weaknesses in the law, such as the failure to offer protection to women who run away from home to escape abuse and are then detained for "moral crimes," needed to be amended.

Twelve of 28 special women's groups that the law required to be set up to stop violence in rural areas have collapsed, UNAMA said in the report.

MISSED CASES

UNAMA cited cases where the law was or should have been used, including that of two sisters, 15 and 17, who were killed in western Herat province in July 2010 after the elder sister refused to marry an older man.

The future husband and father-in-law were sentenced to 16 years in prison, while three other people were acquitted.

In central Daikondi province, a prosecutor used the law to challenge a verdict by a court that found two girls impregnated by a 60-year-old religious leader guilty of adultery. An appeals court rejected that challenge, the U.N. mission said.

A woman in southern Kandahar province complained in March of her daughter's forced suicide. She said her daughter, who had been sold into marriage for $6,600, set herself on fire in her room when, after 10 years of the marriage, her in-laws forced her to have sex with three male guests visiting the family.

"She was always saying that she would burn herself one day. I would tell her, please tolerate, this is life as it comes and one day you will have a bright future," the mother complained, according to the report. Police did not investigate.

The report was based on 261 interviews and research with judicial, police and government officials as well as U.N. monitoring of cases of violence between March 2010 and September 2011. UNAMA said comprehensive statistics are impossible to obtain since most cases go unreported.

Beach radiation deadline issued

Scotland's environmental watchdog has given the MoD until the end of February to devise a plan to make safe a Fife beach contaminated with radioactivity.

Sepa said that if the deadline was not met the land at Dalgety Bay would be declared officially contaminated.

The radiation is thought to be linked to the remains of wartime aircraft buried in the area.

Over the past few months more than 200 radioactive particles have been discovered.

The area was cordoned off last month for further investigation into radioactive sources.

The radioactivity is thought to come from dials of World War II aircraft.

Dalgety Bay hosted a wartime airfield, where many aircraft were dismantled.

The dials in the planes were coated with radioactive radium so they could be read at night.

Following a meeting between Sepa, the MoD and members of the local community, Sepa's radioactivity specialist Dr Paul Dale told BBC Scotland: "We have set out a timetable that we expect a full draft of the MoD's plan by the end of January with a final set of plans by the end of February.

"If that isn't forthcoming, Sepa will continue with its progress to designate the land as contaminated by the end of March."

If Sepa did declare the area as "Radioactive Contaminated Land", it is understood this would be the first time it had happened in the UK.

An area of high radioactivity is only legally declared as contaminated if there is not a suitable action plan in place to deal with the problem.

Environment Secretary Richard Lochhead said: "It is deeply disappointing that this situation has arisen as a result of inaction from the Ministry of Defence.

"I have urged the MoD on a number of occasions to take immediate action and come forward with credible plans to investigate the source of the contamination at Dalgety Bay.

"I would have expected the level of radioactivity to have impelled those responsible to do the right thing for the people of Dalgety Bay and clean up this mess."

He added that despite not receiving a response from the MoD to his letter in October, he would be writing again to Defence Secretary Philip Hammond.

"I am keen to establish the precise nature of their commitment," Mr Lochhead said. "The Scottish government prefers that a voluntary approach is taken by the MoD."

The MoD has not yet issued a response to the deadline but has said it would continue to work with Sepa and the local community to find a resolution.

Independent experts

Radioactive particles were first found on the beach more than 20 years ago.

However, there has recently been an increase in the number of particles found, with more than 100 discovered since the beginning of October.

One particle was 10-times more radioactive than those found previously.

Sepa recently said that if exposed through erosion the material could pose a risk to the community.

It also revealed that further work was carried out last weekend to remove three more sources of radiation from the beach at Dalgety Bay, including one "which gave an extremely high" reading of radioactivity.

Sepa also announced that it plans to establish a group of independent experts in radioactivity to help provide advice and guidance on the contamination at Dalgety Bay.

Former Prime Minister Gordon Brown earlier called for urgent action to tackle the problem.

Chinese left guessing over high speed rail crash (AP)

SHANGHAI ? The investigation into a bullet train crash in China last summer that killed 40 people has come and gone with no public report on what led to the disaster.

The secrecy surrounding the probe, which ended in September, is typical of the sensitivities shown toward wider troubles plaguing the showcase high-speed rail program.

The accident inflamed criticism that the powerful Railway Ministry may be sacrificing safety in its costly quest to quickly roll out the bullet train network. Shortly after the July 23 crash, Premier Wen Jiabao called for a sweeping and transparent investigation.

Based on regulations on major transport accidents, a report on the accident was due by Nov. 20. Railway Ministry officials refused comment Tuesday.

The few slivers of information about the probe have been quickly recanted.

A railway expert and deputy director of the investigation team, Wang Mengshu, backtracked from comments in the state-run Beijing Times newspaper quoting him as saying the crash near the eastern city of Wenzhou largely resulted from mismanagement.

State media on Tuesday carried reports of Wang claiming he was misquoted, that his comments were only his personal opinion, and that he was not authorized to speak to the media.

"I was not involved in the whole investigation. I did not have a general idea of the whole thing, and I did not know whether the conclusion had been submitted," Wang told state-run CCTV.

Wang did not respond to calls and e-mailed requests for comment.

In comments on the work safety administration's website, Wang promised full and accurate disclosure of the probe's findings.

The lack of transparency has left some in China skeptical that problems with the high speed rail network are being resolved, said Li Hongchang, an economics professor at Beijing Jiaotong University.

"People want not just the report but to understand how it was compiled. Openness and credibility are actually more important than the report itself," Li said.

Shortly after the accident, authorities blamed problems with the high-tech signaling systems used to run and route the trains for the crash. The collision occurred after railway staff failed to notice anything amiss when a lightening strike stalled a train and the signaling system failed to turn red.

But they have since backed away from that analysis. The Beijing Times report quoted Wang as saying the lack of problems with the same signaling systems on other lines suggests human error was to blame.

Similarly, Shanghai authorities initially blamed a Sept. 27 subway crash that injured nearly 300 on malfunctioning signaling systems. Later they said it resulted from mismanagement and inadequate training. A dozen subway workers were punished.

The Wenzhou crash prompted inspections of dozens of projects and 3,700 miles (6,000 kilometers) of bullet train line ? but few public disclosures of the results of those checks.

Those working in the industry report widespread problems with skimping on construction materials and other safety compromises as the already heavily indebted Ministry of Railways struggles to pay suppliers and workers.

Reports of uncertified contractors and illegal subcontracting, substitution of substandard cement and steel reinforcing bars and other shortcuts ? problems epidemic in China's construction sector ? are raising questions over just how sound all that fancy modern infrastructure will be in years to come.

In one recent case involving construction of a railway line in northeastern China, the ministry ordered almost the entire $360 million project redone after finding that contractors had farmed the work out to unqualified construction companies.

Instead of concrete, the builders filled the railway bridge's foundations with rocks and sand.

The problems are not limited to construction. After the Wenzhou crash, dozens of CRH 380BL trains used on the recently opened Beijing-to-Shanghai line were recalled. The manufacturer, state-owned CNR Corp., blamed quality defects in outsourced parts for the trains' braking systems.

The trains were repaired, tested and brought back into service last week.

Li, of Beijing Jiaotong University, says the problems reflect a lack of accountability, and an obsession with growth at any cost.

"There are management problems behind every accident," Li said. "The railways issues are more fundamental; not just an excessive concentration of power in the Railway Ministry, but also its lack of market-oriented decision making."

China has 13 high-speed railways in operation, with 26 under construction and 23 more planned, although approvals of new projects were frozen following the Wenzhou crash.

Earlier plans called for expanding the network to 10,000 miles (16,000 kilometers) of track by 2020.

The industry's troubles became apparent in February, when longtime Railways Minister Liu Zhijun was dismissed for unspecified "severe violations of discipline."

China originally planned some 700 billion yuan for railway construction this year, but in January-October it spent only 367 billion yuan, down 28 percent from a year earlier.

Wall Street ends down for fifth day on Europe (Reuters)

NEW YORK (Reuters) ? Stocks fell for a fifth day on Tuesday, having lost more than 5 percent over that period as borrowing costs in Spain hit another record.

Based on the latest available data, the Dow Jones industrial average (.DJI) was down 52.37 points, or 0.45 percent, at 11,494.94. The Standard & Poor's 500 Index (.SPX) was down 4.85 points, or 0.41 percent, at 1,188.13. The Nasdaq Composite Index (.IXIC) was down 1.86 points, or 0.07 percent, at 2,521.28.

Kardashian (somehow) takes lead on 'DWTS'

Monday night marked the first round of the finals on ?Dancing With the Stars,? as Rob Kardashian joined season-long favorites J.R. Martinez and Ricki Lake for the penultimate dance-off.

That?s right, Kardashian, who, in the early weeks of the competition, stood out for sloppy footwork, a lack of musicality and poor posture, made it to the final three. Stranger still? He snagged the top spot on the leaderboard Monday night.

No, really.

While a come-from-behind success for a non-dancer is just what ?Dancing? should be about, some ballroom fans might find it hard to cheer for Kardashian?s sudden surge to the top ? mainly because it wasn?t exactly warranted.

Sure, the ?Keeping Up With the Kardashians? sibling improved over the course of the season and arguably earned his spot in the finals, but the performances he put on once he got there didn?t reflect his newfound abilities.

In his first dance of the night, a waltz alongside two-time champ Cheryl Burke, Kardashian remembered the moves and maintained the time, but let his footwork, arm lines and posture lag. All three of the judges noticed flaws and commented on them, although in the case of seeming Kardashian superfan Carrie Ann Inaba, the nitpick almost sounded like a compliment.

?You made it to the ball!? she raved after dubbing him a ?male Cinderella? and throwing in only a quick mention of flubbed footwork.

While head judge Len Goodman and Bruno Tonioli didn?t seem quite as excited, they must have been holding back, because, like Inaba, they awarded the dance a near-perfect set of 9s.

But that was far from the highlight of the night for Kardashian. When he returned to the stage for a freestyle routine filled with even more posture problems and imprecise elements, the judges were completely blind to the problems. They noticed only the impressive lifts he performed (but not the not-so-impressive Burke-groin-grab).

For that, Kardashian raked in a set of perfect 10s.

?I never thought I?d get a perfect score,? he said after the routine.

As for those fan-favorite hoofer hopefuls who?ve been swapping the top spot on the leaderboard for most of the ballroom battle, Martinez and Lake ended the night with a tie ? each trailing Kardashian by three points.

Martinez, who showed no signs of ankle problems after his sprain last week, kicked off the night on the wrong foot. In a cha-cha-cha with pro partner Karina Smirnoff, the war-hero-turned-actor lost the beat just two steps into the dance.

The judges were unanimous when it came time to deliver their critical comments, but they weren?t of the same mind when it came to flashing their paddles. The routine earned an 8 from Carrie Ann, a 7 from Len and a 9 from Bruno.

That odd score didn?t hold Martinez back, as his lift- and jump-filled freestyle wowed the crowd and brought the judges to a perfect-10 consensus.

Lake was the lone dancer of the night who didn?t make any major mistakes. Her first dance, a cha-cha-cha, lacked a little fluidity, and her freestyle effort featured a tiny bit of last-step dizziness (the fault of which belong strictly to spin-happy pro Derek Hough), but the dances were strong. Of course, not quite strong enough to compete with Kardashian?s inflated scores. Lake earned all nines for the night.

Tuesday night is the real test. That?s when viewer votes are added to the judges? scores from night one, and the dancers get one more shot to show the panel what they can do. Can Kardashian continue his late-game streak? Will Lake reclaim the lead? Or will Martinez get that mirror ball trophy, just as most fans have expected since premiere night? It?s anyone?s game.

Ree Hines was rooting for Maksim Chmerkovskiy in the first night of the finals. Sure, he wasn?t in the competition anymore, but who says you can?t root for hot hoofers in the audience? Grab the salt shaker folks -- if Nikon Rumors is to be believed, what you're gazing at is Nikon's hotly rumored D800 DSLR. The camera is reportedly packing goodies like a massive 36 megapixel sensor capable of 7360 × 4912 resolution, and an ISO range of 100 to 6,400 that's pushable to 25,600. Furthermore, you can expect to find the same 51-point AF system found in the D3s, slots for SD and CF cards, USB 3.0 connectivity and over three-inches of display on back -- all while being "smaller and lighter" than the current D700. Notably, Nikon is apparently stepping up its DSLR video chops with this cam as well, as it's said to be capable of filming 1080p HD video at 30 fps, while 720p grants you up to 60 fps. Of course, this type of primo kit won't come cheap -- if it all proves true you can expect to slap down roughly $3,900 (¥300,000) to make one yours, although, a release date is still anyone's guess. LivingSocial seeks to raise $200 million: NYT (Reuters)

(Reuters) ? LivingSocial, the online deal provider, is looking to raise nearly $200 million from new and old investors, the New York Times reported on Friday.

The company is also considering a credit facility worth about $100 million, the paper said, quoting two unnamed sources who said they had been briefed on the transaction.

The injection of cash, which is expected to close next week, would give the company a value of more than $5 billion, the paper said, quoting one unnamed source.

That would give the online deals company more flexibility as it attempts to take on chief rival Groupon, which went public earlier this month.
